This page describes the terms and conditions that govern your use of certain The Alaska Airlines Center digital products, including several interactive web sites (collectively, our “Web Sites”) and mobile applications, offered by The Alaska Airlines Center (“we”, “us” or “our”). The Alaska Airlines Center is an arena on the University of Alaska Anchorage Campus.

 

  1. GENERAL RULES

1.1 If you choose to use our Web Sites, mobile sites and applications, any of the features of this site, including but not limited to RSS, API, software and other downloads (collectively, the “Services”), you will be agreeing to abide by all of the terms and conditions of these Terms of Service between you and The Alaska Airlines Center.

1.2 We may change, add or remove portions of these Terms of Service at any time. Any such changes shall become effective immediately upon posting. Therefore, it is your responsibility to review these Terms of Service prior to each use of our Web Sites and by continuing to use our Web Sites, you agree to any changes.

1.3 IF ANY OF THESE RULES OR ANY FUTURE CHANGES ARE UNACCEPTABLE TO YOU, YOU SHOULD DISCONTINUE YOUR USE OF THE SERVICES AND CANCEL YOUR SUBSCRIPTION BY CONTACTING US AT aac.boxoffice@alaska.edu YOUR CONTINUED USE OF THE SERVICES NOW, OR FOLLOWING THE POSTING OF NOTICE OF ANY CHANGES TO THESE TERMS OF SERVICE, WILL INDICATE YOUR ACCEPTANCE OF SUCH RULES AND CHANGES OR MODIFICATIONS THERETO.

1.4 We may change, suspend or discontinue any aspect of the Services at any time, including the availability of any Services feature, database, or content. We may also impose limits on certain features and services or restrict your access to parts or all of the Services without notice or liability. However, in no event will we make changes to paid Services without first providing you notice of such changes.

 

  1. CONTENT OF THE SERVICES

2.1 The contents of the Services, including our Web Sites, are intended for your personal, noncommercial use. All materials published on the Services (including, but not limited to articles, photographs, images, illustrations, audio clips and video clips, also known as the “Content”) are protected by copyright, and owned or controlled by The Alaska Airlines Center or the party credited as the provider of the Content. You shall abide by all additional copyright notices, information, or restrictions contained in any Content accessed through the Services.

2.2 The Services and Contents are protected by copyright pursuant to U.S. and international copyright laws. You may not modify, publish, transmit, participate in the transfer or sale of, reproduce (except as provided in Section 2.3 of these Terms of Service), create new works from, distribute, perform, display, or in any way exploit, any of the Content or the Services (including software) in whole or in part.

2.3 You may download or copy the Content and other downloadable items displayed on the Services for personal use only, provided that you maintain all copyright and other notices contained therein. Copying or storing of any Content for other than personal use is expressly prohibited without prior written permission from us or the copyright holder identified in the copyright notice contained in the Content.

2.4 The Content of the Services is owned or licensed to us.

2.5 The Alaska Airlines Center makes reasonable efforts to ensure its CMS is compliant with Web Content Accessibility Guidelines (WCAG) 2.0 requirements. This includes designing sites to be as inclusive as possible, so The Alaska Airlines Center’ partners have the opportunity to make all generated content accessible to their fans. In the event The Alaska Airlines Center does not meet the standards set forth by a partner’s interpretation of WCAG 2.0, The Alaska Airlines Center will work with the school and its staff to address any concerns. While The Alaska Airlines Center can provide the above assurances, it cannot control nor is it responsible for any content that is uploaded to its CMS. This includes, but is not limited to, textual content, photos, graphics, audio, or video files. It is the responsibility of each school partner, and specifically the users of The Alaska Airlines Center’ system, to upload content that meets the above requirements.

 

  1. ACCESS AND AVAILABILITY OF OTHER SERVICES AND LINKS

3.1 The Services contain links to other related World Wide Web Internet sites, resources, and advertisers. Since we are not responsible for the availability of these outside resources, or their contents, you should direct any concerns regarding any external link to the administrator of such site.

 

  1. USER GENERATED CONTENT (INCLUDING COMMENTS)

4.1 You shall not upload to, or distribute or otherwise publish on to the Services any libelous, defamatory, obscene, pornographic, abusive, or otherwise illegal material.

You agree that you will not threaten or verbally abuse other users, use defamatory language, or deliberately disrupt discussions with repetitive messages, meaningless messages or “spam.”

You agree not to use language that abuses or discriminates on the basis of race, religion, nationality, gender, sexual preference, age, region, disability, etc. Hate speech of any kind is grounds for immediate and permanent suspension of access to all or part of the Services.

4.2 The Services shall be used only in a noncommercial manner. You shall not, without the express approval of The Alaska Airlines Center, distribute or otherwise publish any material containing any solicitation of funds, advertising or solicitation for goods or services.

4.3 You acknowledge that any submissions you make to the Services (i.e., user-generated content including but not limited to: comments, forum messages, text, video, audio and photographs, as well as computer code and applications) (each, a “Submission”) may be edited, removed, modified, published, transmitted, and displayed by The Alaska Airlines Center and you waive any rights you may have in having the material altered or changed in a manner not agreeable to you. Submissions made to the Services may also be included in our RSS feeds, APIs and made available for republishing through other formats.

4.4 You grant The Alaska Airlines Center a perpetual, nonexclusive, world-wide, royalty free, sub-licensable license to the Submissions, which includes without limitation the right for The Alaska Airlines Center or any third party it designates, to use, copy, transmit, excerpt, publish, distribute, publicly display, publicly perform, create derivative works of, host, index, cache, tag, encode, modify and adapt (including without limitation the right to adapt to streaming, downloading, broadcast, mobile, digital, thumbnail, scanning or other technologies) in any form or media now known or hereinafter developed, any Submission posted by you on or to the Services or any other of our Web Sites, including any Submission posted on or to the Services through a third party.

4.5 You are solely responsible for the content of your Submissions. However, while The Alaska Airlines Center does not and cannot review every Submission and is not responsible for the content of these messages, The Alaska Airlines Center reserves the right to delete, move, or edit Submissions that it, in its sole discretion, deems abusive, defamatory, obscene, in violation of copyright or trademark laws, or otherwise unacceptable.

4.6 By making a Submission, you are consenting to its display and publication on the Site and in the Services and for related online and offline promotional uses.

 

  1. REPRESENTATIONS AND WARRANTIES

5.1 You represent, warrant and covenant (a) that no materials of any kind submitted through your account will (i) violate, plagiarize, or infringe upon the rights of any third party, including copyright, trademark, privacy or other personal or proprietary rights; or (ii) contain libelous or otherwise unlawful material; and (b) that you are at least thirteen years old. You hereby indemnify, defend and hold harmless The Alaska Airlines Center and all officers, directors, owners, agents, information providers, affiliates, licensors and licensees (collectively, the “Indemnified Parties”) from and against any and all liability and costs, including, without limitation, reasonable attorneys’ fees, incurred by the Indemnified Parties in connection with any claim arising out of any breach by you or any user of your account of these Terms of Service or the foregoing representations, warranties and covenants. You shall cooperate as fully as reasonably required in the defense of any such claim. The Alaska Airlines Center reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification by you.

5.2 We do not represent or endorse the accuracy or reliability of any advice, opinion, statement, or other information displayed, uploaded, or distributed through the Services by any user, information provider or any other person or entity. You acknowledge that any reliance upon any such opinion, advice, statement, memorandum, or information shall be at your sole risk. THE SERVICES AND ALL DOWNLOADABLE SOFTWARE ARE DISTRIBUTED ON AN “AS IS” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. YOU HEREBY ACKNOWLEDGE THAT USE OF THE SERVICES IS AT YOUR SOLE RISK.

 

  1. REGISTRATION AND SECURITY

6.1 As part of the registration or account creation process, you will create login credentials by selecting a password and providing an e-mail address. You also have to give us certain registration information, all of which must be accurate and updated.

Each registration is for a single user only. You are not allowed to share your registration login credentials or give your login credentials to anyone else. We may cancel or suspend your access to the Services if you share your login credentials. You are responsible for maintaining the confidentiality of your password, which you will not have to reveal to any representative or agent of The Alaska Airlines Center. You may not (i) select or use the login credentials of another person with the intent to impersonate that person; (ii) use login credentials in which another person has rights without such person’s authorization; or (iii) use login credentials that we, in our sole discretion, deem offensive. Failure to comply with the foregoing shall constitute a breach of these Terms of Service, which may result in immediate suspense or termination of your account.

6.2 Please notify sidearm@sidearmsports.com of any known or suspected unauthorized use(s) of your account, or any known or suspected breach of security, including loss, theft, or unauthorized disclosure of your password or credit card information.

6.3 You must be 13 years or older to subscribe to all parts of the Services.

6.4 You are responsible for all usage or activity on your subscription account, including use of the account by any third party authorized by you to use your login credentials. Any fraudulent, abusive, or otherwise illegal activity may be grounds for termination of your account, at our sole discretion, and we may refer you to appropriate law enforcement agencies.

 

  1. FEES AND PAYMENTS

7.1. We reserve the right at any time to charge fees for access to portions of the Services or the Services as a whole. However, in no event will you be charged for access to the Services unless we obtain your prior agreement to pay such charges. Thus, if at any time we require a fee for portions of the Services that are now free, we will give you advance notice of such fees. You may cancel your account at any time. All new fees, if any, will be posted prominently on our Web Sites and in other appropriate locations on the Service. You shall pay all fees and charges incurred through your account at the rates in effect for the billing period in which such fees and charges are incurred, including, but not limited to charges for any digital products or services offered for sale through the Services by us or by any other vendor or service provider. All fees and charges shall be billed to and paid for by you. You shall pay all applicable taxes relating to use of the Services through your account.

 

  1. COMMUNICATIONS BETWEEN THE ALASKA AIRLINES CENTER AND USERS

8.1 If you indicate on your registration form that you want to receive such information, we, our owners and assigns, will allow certain third party vendors to provide you with information about products and services.

8.2 We reserve the right to send electronic mail to you for the purpose of informing you of changes or additions to the Services.

8.3 We reserve the right to disclose information about your usage and demographics, provided that it will not reveal your personal identity in connection with the disclosure of such information. Advertisers and/or Licensees on our Web Sites may collect and share personal information about you only if you indicate your acceptance. For more information please read our Privacy Policy.

8.4 We may contact you via e-mail regarding your participation in user surveys, asking for feedback on current Services or prospective products and services. This information will be used to improve the Services and better understand our users.

 

  1. SOFTWARE LICENSES

9.1 You shall have no rights to the proprietary software and related documentation, or any enhancements or modifications thereto, provided to you in order to access the Services (“Software”). You may not sublicense, assign or transfer any licenses granted by our Web sites, and any attempt at such sublicense, assignment or transfer shall be null and void. You may make one copy of such software for archival purposes only. You may not otherwise copy, distribute, modify, reverse engineer, or create derivative works from Software.

 

  1. TERMINATION

10.1 You may terminate your account at any time by contacting us at aac.boxoffice@alaska.edu If you are a paying subscriber and are unsatisfied with the quality of the product or Services we provided, we will void your transaction and refund you the full cost of the purchase within 48 hours of receiving your notice of termination. If you are a paying subscriber of yearly or multi-month services and are unsatisfied with the quality of the product or Services we provided, we will issue you a pro-rated refund of the purchase.

10.2 The Alaska Airlines Center may, in its sole discretion, terminate or suspend your access to all or part of the Services for any reason, including, without limitation, breach or assignment of these Terms of Service.

 

  1. MISCELLANEOUS

11.1 These Terms of Service have been made in and shall be construed and enforced in accordance with Alaska law. Any action to enforce these Terms of Service shall be brought in the federal court located in Anchorage, Alaska or in the state court located in Anchorage, Alaska.

11.2 Notwithstanding any of the foregoing, nothing in these Terms of Service will serve to preempt the promises made in the The Alaska Airlines Center Privacy Policy.

11.4 You agree to report to us any copyright violations of the Terms of Service as soon as you become aware of them. In the event you have a claim of copyright infringement with respect to material that is contained in our Web Sites’ service, please notify aac.boxoffice@alaska.edu

11.5 The Alaska Airlines Center will not be responsible for any failure or delay in its performance due to causes beyond its reasonable control, including but not limited to labor disputes, strikes, lockouts, shortages of or inability to obtain labor, energy, raw materials or supplies, war, riot, act of God or governmental action.

We, The Alaska Airlines Center, explain in this policy how we collect, process, use, share, and secure the information that we receive from users via our websites, mobile apps, and over email (together, the “Alaska Airlines Center Services”). This policy also explains your choices regarding the use of, access to, and correction of your personal information.

 

This policy only applies to information The Alaska Airlines Center itself collects through the The Alaska Airlines Center Services. The Alaska Airlines Center develops and maintains websites and mobile apps for many different schools and conferences (our “clients”). This policy does not apply to how individual The Alaska Airlines Center clients may process, use, or share information they collect from the The Alaska Airlines Center Services. The Alaska Airlines Center has no control over how its clients process, use, or share the information they collect via the The Alaska Airlines Center Services.

 

By visiting or using any of the The Alaska Airlines Center Services, you consent and agree to be bound by the terms of this Privacy Policy and our Terms of Use and acknowledge that you may be transferring your data to, and consent to having your data transferred to, and processed in, the United States. This Privacy Policy may be amended from time to time. Any such changes will be posted on this page. If we make a significant or material change in the way we use your personal information, the change will be posted on this page thirty (30) days prior to taking effect and registered users will be notified via email.

 

  1. INFORMATION COLLECTION

The Alaska Airlines Center gathers the following types of information about users when they access and use The Alaska Airlines Center Services.

  1. Information you voluntarily provide. Certain of the The Alaska Airlines Center Services we offer to our clients requires users to provide certain personal information. These services include:

Personalization of Platform Through User Preferences

Bidding or Purchasing Goods through Auctions or Storefronts

SMS or Email Registration

Signup for Paid Audio or Video Streaming

Surveys or Contests

Registration for Client Events such as Sports Camps

Signup for Clients’ “Kids Clubs” or Similar Programs

Your use of these features is voluntary, but if you do use one of these features, you consent to The Alaska Airlines Center Services’ collection of the following information:

Account Set-Up Information: The Alaska Airlines Center will collect certain information to set up an account for you via one of our sites, such as your name, email address, mailing address, phone number(s), and the username and password you create.

Credit Card/Payment Information: If you purchase an item via an auction or an online store or register for a camp using the The Alaska Airlines Center Services, The Alaska Airlines Center will collect certain information such as your credit card number and billing address to process that payment.

Sports or Athlete Interests: If you voluntarily register to personalize your use of the The Alaska Airlines Center Services, including a website or a mobile app, then The Alaska Airlines Center may collect personal information such as specific sports or student athletes you wish to follow.

Social Media Information: If you use Facebook or another third party social network site to login to any The Alaska Airlines Center Services, The Alaska Airlines Center will collect information that you chose to provide to us (for example your Facebook profile information). The information collected may depend on the privacy settings you have with the third-party site.

Certain Additional Information: The Alaska Airlines Center provides our clients with certain Services such as surveys or contests that may ask you certain questions to participate. Participation in these surveys and contests is voluntary.

 

  1. Children’s Information. The Alaska Airlines Center offers certain Services to its clients specifically geared towards children. In accordance with COPPA, The Alaska Airlines Center does not knowingly collect or store any personal information about children under the age of 13, other than certain limited information provided by a child’s parent or authorized guardian, such as information provided to sign kids up for camps or clinics run by The Alaska Airlines Center clients or for a client sponsored Kids Club.

Kids Club Registrations: Some of The Alaska Airlines Center’ clients offer children under the age of 13 the opportunity to join “kids clubs” or similar programs to provide them with information about university athletics that is specifically geared towards children. Registration for these clubs requires that SIDEARM obtain certain personal information about participants. We do not collect personally identifiable information on our websites from children under the age of 13 without prior parental consent. We do not ask children to disclose more information than is necessary for them to participate in a particular activity, and we take steps to prevent children from disclosing more information than is necessary to participate in those activities.

Continuing Notification of Parents: For children under the age of 13, parents will initially provide certain personal information about or for their child; we will not collect it from the child directly. If a child under age 13 then participates in any ongoing activity that requires the collection, retention, and use of personal information in addition to what has already been provided or authorized by the parent, we will also ask for a parent’s e-mail address so that we can notify the parent that we have received personal information from their child and seek consent to retain this information. We do not knowingly collect names and e-mail addresses or other personally identifying information from children under age 13 for these types of activities without notifying the parent via e-mail and giving the parent the option to remove their child’s e-mail address from the applicable database for that activity.

Changes in Guidelines: These children’s guidelines have been developed with the recognition that Internet technology evolves rapidly and that underlying business models are still not established. Accordingly, guidelines are subject to change. In the unlikely event of such changes they will be posted on this page. If the changes represent a material departure from our current practice with respect to the use of children’s personal information, the changes will be posted on this page thirty (30) days prior to taking effect and will not affect children’s personal information previously collected.

 

  1. Information Collected From You Automatically. The Alaska Airlines Center uses various Internet technologies to manage and track use of the The Alaska Airlines Center Services. Non-personal information that we collect using these technologies may be combined with the personal information that you may voluntarily provide us when using certain specific services.

Device Information: We may collect non-personal information about the computer, mobile device, or other device you use to access the The Alaska Airlines Center Services, such as your computer’s unique IP address, geolocation information, unique device identifiers, browser type, browser language and other transactional information.

Cookies, Beacons, Local Storage and Other Similar Technologies: The Alaska Airlines Center uses “cookies,” Web beacons, HTML5 local storage, and other similar technologies. These technologies allow us to manage access to and use of the The Alaska Airlines Center Services, recognize users and provide personalization, and help us to understand how users engaged with the The Alaska Airlines Center Services. You will not be able to access certain areas of our websites if your computer does not accept cookies from us. We do not respond to browser-based “do not track” signals.

Analytics Technologies: We have engaged with a third-party service called Google Analytics to provide us information, reports, and analysis about the usage, browsing patterns of users of the The Alaska Airlines Center Services. Google Analytics tracks and analyzes non-personally identifiable usage and volume statistical information from our visitors and customers on our websites. All data collected by Google Analytics on our behalf is owned and used by us. Location Information: Some of our mobile applications can deliver content based on your current location if you choose to enable that feature of the app. If you enable the location-based feature, your current location will be stored locally on your device, which will then be used by the app. If you elect to have a location-based search saved to your history, we will store that information on our servers. If you do not enable the location-based service, or if an app does not have that feature, the app will not transmit to us, and we will not collect or store location information.

Email Tracking Pixels: The Alaska Airlines Center may use a function in HTML emails to track which users open emails and which links they click.

Ads Within Our Apps: The ads you see may be targeted to you based on your current GPS location, proximity of your device to an active beacon or low-energy blue-tooth transmitter, your device’s IP address or ZIP code, and user provided location information such as seat location. Some mobile applications promoted through the The Alaska Airlines Center Services may be links to third-party services. Such services shall be governed by their own privacy policy.

 

  1. Information Collected by Third Parties Some of the services and advertisements included in the The Alaska Airlines Center Services, including on the websites we create and maintain for our clients and within our mobile apps, are delivered or served by third-party companies. These companies may place or recognize cookies, Web beacons, or other technology to track certain non-personal information about our website users. For example, an advertiser may place or recognize a unique cookie on your browser to collect certain information about your use of the The Alaska Airlines Center Services. In many cases, this information could be used to show you ads on other websites based on your interests.

 

We do not have access to, nor control over, advertisers’ or service providers’ use of cookies or other tracking technologies or how they may be used.

Your access to The Alaska Airlines Center websites should not be affected if you do not accept cookies served by third parties. Some of the ad servers and ad networks may be members of the Network Advertising Initiative, which offers a single location to opt out of ad targeting from member companies. If you opt out of receiving targeted ads from ad servers and ad networks on our websites, you will continue to receive advertising and promotional messages, but they will not be customized or personalized to you based on your use of our websites and/or third party websites.

  1. HOW WE USE INFORMATION

The Alaska Airlines Center uses the data we collect from you for the following purposes:

Most importantly, we use the information collected from our users to provide you with the products or services you voluntarily signed up for, such as:

Enabling you to participate in features such as surveys or contests

Providing you with electronic newsletters or text messages containing special offers or promotional materials

Customizing the content you see when visiting a The Alaska Airlines Center website

Other purposes The Alaska Airlines Center disclosed to you when we requested you provide us with or allow us access to your information.

 

In addition, The Alaska Airlines Center uses the information you provide to improve the Services we offer, enhance the experience users have using our Services, and to communicate with users in case of any issues.

Statistical Analysis: We perform statistical, demographic and marketing analyses of users of the The Alaska Airlines Center Services and their subscribing and purchasing patterns for product development purposes and to generally inform advertisers about the nature of our subscriber base. We use this information for analysis purposes, including analysis to improve customer relationships.

Relevant Advertising: We may use demographic and preference information to allow advertising on the The Alaska Airlines Center Services to be targeted to the users for whom they are most pertinent. This means users see advertising that is most likely to interest them, and advertisers send their messages to people who are most likely to be receptive, improving both the viewer’s experience and the effectiveness of the ads. We disclose information to third parties only in aggregate or de-identified form.

 

Credit Card Data: The Alaska Airlines Center does not store any of your credit card data on our servers. The data is encrypted and securely stored by an independent company, Authorize.net, which provides payment processing services for The Alaska Airlines Center.

 

  1. WHO YOUR INFORMATION IS SHARED WITH

The Alaska Airlines Center neither rents nor sells your personally identifiable information to anyone. We share your personal information only as provided herein or with your consent, to the entities described below for the following purposes:

Schools/Clients: The Alaska Airlines Center partners with hundreds of colleges, universities, and high schools across North America. We may share your information with those clients whose sites or mobile apps you digitally visited.

 

We may disclose your personal information to partners, who may use it to:

o Provide collaborative content and services (like registration, transactions, and customer support)

o Provide you with personalized advertising

o Other uses of this data, in accordance with their terms and policies.

 

Additionally, in the future, we may sell, buy, merge or partner with other companies or businesses. In such transactions, we may include your information among the transferred assets.

 

Law Enforcement: We may disclose personal information if we are required to do so by law or we have a good faith belief that such action is necessary to (1) comply with the law or with legal process; (2) protect and defend our rights and property; (3) protect against misuse or unauthorized use of the The Alaska Airlines Center Services; or (4) protect the personal safety or property of our users or the public (among other things, this means that if you provide false information or attempt to pose as someone else, information about you may be disclosed as part of any investigation into your actions).

Participation: When you participate in a contest, sweepstakes, or promotion, the information you provide made be shared with a third-party sponsor of the contest, sweepstakes, or promotion. You will be notified how your information is shared when you sign up for the contest, sweepstakes, or promotion. If you do not want any personal information shared with a third-party, you should not participate in the sweepstakes, contest or promotion.

Service Providers: We use other companies to help us provide the The Alaska Airlines Center Services to you. As a result, these partner companies will have some of your information in their systems. Our partners are subject to contractual obligations governing data security and confidentiality consistent with this Privacy Policy and applicable laws. These service providers are restricted from using this data in any way other than to provide services for The Alaska Airlines Center, and they may not share, resell or use the data for their own direct marketing purposes.

Aggregated Data: The Alaska Airlines Center may disclose user information in an aggregated form as part of our marketing or analytical findings data that may be published. Such disclosure will never include personal information.

Links to Third Party Sites: The The Alaska Airlines Center Services may include links that direct you to other websites or services whose privacy practices may differ from ours. Once you access that website or other service, your information is governed by their privacy policies, not this one.

 

  1. PROTECTING YOUR INFORMATION

Control of Information: In most cases you can login to your The Alaska Airlines Center Services account and update your account information and communication preferences.

For an Audio/Video streaming account you can login to your account and update your information and/or deactivate your account

For newsletter subscriptions you can click the “unsubscribe” link on the bottom of the communication

For SMS notifications you can reply “stop” which will end future notifications.

For any other requests you can email aac.boxoffice@alaska.edu and we will contact you to discuss and handle your request to the best of our ability.

 

How long we keep your information: Following cancellation or deactivation of your account, The Alaska Airlines Center may retain your information for a commercially reasonable amount of time for backup or audit purposes. Please contact us at aac.boxoffice@alaska.edu if you wish to delete your account.
